Welcome to Foster My Pawws. These Terms of Service govern your access to and use of the Foster My Pawws website, mobile services, and platform (collectively, the “Service”). By creating an account, signing in, browsing pets, submitting a foster application, or subscribing to a paid plan, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
Foster My Pawws is a Los Angeles-based foster-matching platform that connects prospective foster caretakers with rescue animals made available by participating rescue groups, shelters, and LA County Animal Care centers (“Partner Organizations”). The Service displays pet profiles, collects foster applications, and provides tools for applicants and Partner Organizations to coordinate placements.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use the Service. You must reside in or near the Greater Los Angeles area, or otherwise be able to provide in-person foster care for an animal listed in the Service. Accounts created by minors or by automated means are not permitted.
3. Account Registration & Security
You may register with an email address, phone number, or an approved social-login provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at FosterMyPawws@gmail.com if you suspect unauthorized access.
4. Foster Agreement & Indemnity Waiver
Before you may view or accept a foster placement through the Service, you are required to sign a legally binding digital contract. By signing, you acknowledge and agree that:
- Foster Agreement: You assume the inherent risks of housing an animal with unpredictable behavior. Animals may bite, scratch, escape, damage property, or cause injury regardless of their disclosed history. You accept full responsibility for the animal’s day-to-day care, safety, and supervision while in your custody.
- Indemnity Waiver: To the maximum extent permitted by law, you release, waive, discharge, and covenant not to sue Foster My Pawws LLC, its owners, employees, volunteers, and agents from any and all financial liability, claims, demands, or causes of action for property damage, personal injury, medical bills, emotional distress, or other losses arising out of or relating to your foster placement or use of the Service.
Your signed agreement is stored in connection with your account. We reserve the right to refuse access to pet profiles or applications until the agreement is complete.
5. Shelter-Backed Medical Model
Foster My Pawws does not provide veterinary care. Medical care is arranged, managed, and funded by the applicable Partner Organization at their approved clinics. When the Partner Organization provides contact details, we display them on the pet’s profile for signed-in users. You agree to direct all veterinary questions, emergencies, and reimbursement requests to the Partner Organization, not to Foster My Pawws.
6. Payments, Subscriptions & Refunds
We offer optional paid subscriptions, including but not limited to Foster Premium and Shelter Software tiers. All fees are listed in U.S. dollars and billed through our payment processor, Stripe, Inc. By subscribing, you authorize recurring charges until you cancel.
- Renewals: Subscriptions automatically renew for the same period unless canceled before the renewal date.
- Cancellation: You may cancel at any time through the billing portal in your dashboard or by contacting us at FosterMyPawws@gmail.com. Cancellations take effect at the end of the current billing period.
- Refunds: Fees are generally non-refundable. We may issue a partial refund at our sole discretion if you contact us within 7 days of a charge and can demonstrate a technical or billing error.
- Price changes: We may adjust subscription prices with at least 14 days’ notice before the next renewal.
7. Staff, Owner & Team Accounts
Foster My Pawws staff, administrators, and owners may be added through an invitation-only flow. Team members are responsible for using staff permissions only for legitimate business purposes. Staff actions related to pet listings, applications, and communications are taken on behalf of Foster My Pawws LLC.
8. User Conduct
You agree not to:
- Misrepresent your identity, housing situation, or foster experience.
- Use the Service to harass, abuse, or discriminate against any person or organization.
- Scrape, copy, or resell data from the Service without written permission.
- Introduce malware, bots, or other harmful code.
- Circumvent any access controls, including the Foster Agreement gate.
We may suspend or terminate accounts that violate these rules or that we reasonably believe pose a risk to animals, users, or Partner Organizations.
9. Content & Intellectual Property
All text, images, software, logos, and designs in the Service are owned by Foster My Pawws LLC or its licensors and are protected by copyright, trademark, and other laws. You may not use our trademarks or logos without prior written consent. Pet photos and stories are shared with permission from Partner Organizations and may not be downloaded or reused without authorization.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY PET LISTING IS ACCURATE, CURRENT, OR AVAILABLE. WE DO NOT GUARANTEE THAT ANY FOSTER APPLICATION WILL BE APPROVED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Foster My Pawws LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
12. Indemnification
You agree to indemnify and hold harmless Foster My Pawws LLC, its affiliates, officers, employees, agents, and licensors from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your foster placement, your violation of these Terms, or your violation of any third-party right.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in Los Angeles County, California, administered by JAMS under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use after the effective date of the revised Terms constitutes acceptance.
